On July 1st, 2016, the U.S. Department of Justice, which oversees the FBI’s cyber-crime and data-slinging efforts, issued what is likely the most important cyber-crime classification order since the bureau began to aggressively pursue white-collar hackers in 1995: a “National Security Letter,” or NSL, requiring Internet service providers, including ISPs, to turn over information that is “relevant to authorized investigations” of cyber-criminals. This includes private data such as names, addresses, social security numbers, and IP addresses, information that many Internet businesses, including those in the banking sector, have received or used to comply with NSLs.
The order has sparked debate among Internet service providers (ISPs) and the government over how the orders can be applied, and what powers, if any, the government has over Internet companies. Critics—especially those who oppose the surveillance powers that the NSLs may afford the government—say the order is overbroad, overly broad, and even potentially unconstitutional.
